If a ship is dealt damage can I respond by playing Insurance Fraud and gaining ISK?

Yes. As long as you play Insurance Fraud before the pile resolves, Insurance Fraud will have entered play before the damage resolves and therefore give you ISK. Insurance Fraud has a continuous ability that applies for as long as Insurance Fraud stays in play.
